1. INTRODUCTION AND ACCEPTANCE


Welcome to MyBuildr. These Terms and Conditions ("Terms") constitute a legally binding agreement between MyBuildr Marketing Inc. ("MyBuildr," "we," "us," or "our"), registered at 48 Webb Circle, Haliburton, Ontario K0M1S0, Canada, and you ("User," "you," or "your").


These Terms govern your use of:

  • The MyBuildr platform and website
  • Website building tools and services
  • AI-powered branding tools
  • All related applications and services (collectively, "Services")


BY USING THE SERVICES, YOU CONFIRM AND ACKNOWLEDGE THAT:


  1. You have read and understand these Terms
  2. You agree to be bound by these Terms
  3. You have the legal authority to enter into this agreement
  4. If representing a business entity, you have the authority to bind that entity
  5. If you do not agree to these Terms, do not use our Services.


WE MAY, IN OUR SOLE DISCRETION, LIMIT, SUSPEND, TERMINATE, MODIFY, OR DELETE YOUR ACCOUNT, YOUR SITES, ANY OF YOUR CLIENT’S SITES, ACCESS TO THE SERVICES OR ANY PORTION OF THEM; PROHIBIT ACCESS TO OUR SERVICES AND PLATFORM, AND OUR CONTENT, SERVICES, AND TOOLS; OR DELAY OR REMOVE HOSTED CONTENT, AND WE ARE UNDER NO OBLIGATION TO COMPENSATE YOU FOR ANY LOSSES OR RESULTS.

3. SUBSCRIPTION AND PAYMENTS


3.1 Free Trial Terms

3.1.1 MyBuildr offers a limited-time free trial that provides access to the brand story creation tools and website builder functionality ("Free Trial"). The Free Trial: (a) Explicitly excludes website publishing capabilities; (b) Does not require payment information for activation; (c) Provides access to a limited subset of features as determined by MyBuildr in its sole discretion; (d) Creates no obligation to purchase any paid subscription; and (e) May be modified or terminated by MyBuildr at any time without prior notice.


3.1.2 MyBuildr reserves the right to: (a) Modify the features available during the Free Trial at any time; (b) Terminate any Free Trial for any reason without notice; and (c) Limit Free Trial eligibility to prevent abuse.


3.2 Payment Terms and Processing

3.2.1 Payment Processing: (a) All payments shall be processed through Stripe, Inc. ("Payment Processor"); (b) By providing payment information, User authorizes MyBuildr and its Payment Processor to charge the designated payment method for all fees incurred; (c) User agrees to comply with the Payment Processor's terms of service.


3.2.2 Billing Terms: (a) All fees are denominated and charged in United States Dollars (USD); (b) Subscriptions automatically renew on a monthly basis unless cancelled in accordance with Section [X]; (c) Payment is required before service activation and at the beginning of each billing cycle; (d) User is responsible for maintaining current and valid payment information; (e) All applicable taxes are additional to the stated subscription fees and are the User's responsibility.


3.3 Late Payment and Collection

3.3.1 Late Payment Consequences: (a) MyBuildr reserves the right to suspend or terminate service access immediately upon non-payment; (b) A late payment fee of one and one-half percent (1.5%) per month, or the maximum rate permitted by applicable law, whichever is lower, will be charged on all overdue balances; (c) User shall be responsible for all reasonable costs and expenses incurred by MyBuildr in collecting overdue amounts, including, without limitation, reasonable attorneys' fees and costs.


3.3.2 Collection Process: (a) Accounts with overdue balances may be referred to a collection agency; (b) User shall be responsible for all collection agency fees, which may be based on a percentage of the debt, and all costs and expenses, including reasonable attorneys' fees, incurred in such collection efforts; (c) MyBuildr reserves the right to report delinquent accounts to credit bureaus in accordance with applicable law.


3.4 Refund Policy

3.4.1 Money-Back Guarantee: (a) New subscriptions are eligible for a thirty (30) day money-back guarantee ("Guarantee Period"); (b) Refund requests must be submitted in writing to [support email] within the Guarantee Period; (c) Refunds will be processed using the original payment method unless technically unfeasible.


3.4.2 Refund Exclusions: (a) No refunds will be provided after the Guarantee Period has expired; (b) Partial months or unused subscription time is non-refundable; (c) Setup fees, implementation fees, and custom development fees are non-refundable; (d) Any fees paid for third-party services, domains, or add-ons are non-refundable; (e) Users who have violated the Terms of Service are not eligible for refunds.


3.4.3 Refund Processing: (a) Approved refunds will be processed within thirty (30) business days; (b) MyBuildr reserves the right to deduct any applicable processing fees from refund amounts; (c) Refund eligibility shall be determined by MyBuildr in its sole discretion.


3.5 Dispute Resolution

3.5.1 Payment Disputes: (a) Users must notify MyBuildr of any payment disputes within sixty (60) days of the charge; (b) Disputes must be submitted in writing to [billing email] with detailed information about the disputed charge; (c) MyBuildr will investigate all properly submitted disputes and respond within thirty (30) business days.

4. WEBSITE AND CONTENT OWNERSHIP


4.1 Content Ownership and Rights

4.1.1 User Content Ownership: (a) Users retain all ownership rights to content they create, develop, or upload to the Platform ("User Content"); (b) User Content includes, but is not limited to, text, images, logos, graphics, videos, audio files, data, and other materials uploaded by Users.


4.1.2 User Representations and Warranties: (a) User represents and warrants that: (i) They own or have obtained all necessary rights, licenses, consents, and permissions to use and authorize MyBuildr to use all User Content; (ii) No User Content infringes or violates any third party's intellectual property rights, privacy rights, publicity rights, or other rights; (iii) All User Content complies with applicable laws and regulations.


4.1.3 License Grant to MyBuildr: (a) User grants MyBuildr and its affiliates a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, and transferable license to: (i) Host, store, reproduce, modify, create derivative works of, distribute, and display User Content; (ii) Use User Content for purposes of operating, providing, developing, and improving the Services; (iii) Display User Content in MyBuildr's marketing materials, subject to Section 4.1.4.


4.1.4 Marketing Rights: (a) MyBuildr may use User's website, company name, and logo in marketing materials unless User opts out in writing; (b) User may revoke marketing rights at any time by submitting a written request to [email address].


4.2 Website and Content Retention

4.2.1 Termination Effects: (a) Upon subscription termination or cancellation for any reason: (i) All websites will be immediately taken offline without prior notice; (ii) Access to all platform tools, features, and assets will be immediately revoked; (iii) All templates, designs, and customizations will become inaccessible; (iv) All AI-generated content will become unavailable; (v) No content will be retained on MyBuildr's servers except as required by law.


4.2.2 User Responsibilities: (a) Users are solely responsible for: (i) Backing up all content prior to cancellation or termination; (ii) Maintaining copies of all User Content; (iii) Retrieving any desired content before account closure.


4.2.3 Maintenance Requirements: (a) An active paid subscription is required to: (i) Maintain any website's online status; (ii) Access any platform features or tools; (iii) Utilize any previously created designs or content. (b) MyBuildr has no obligation to maintain or provide access to any content after subscription termination.


4.3 Stock Assets and Licensed Content

4.3.1 License Terms: (a) MyBuildr grants Users a limited, non-exclusive, non-transferable license to use Stock Assets, subject to: (i) Maintaining an active subscription; (ii) Compliance with these Terms; (iii) Any third-party licensing restrictions.


4.3.2 Permitted Uses: (a) Users may: (i) Use Stock Assets within websites created on the Platform; (ii) Modify Stock Assets within the Platform's tools; (iii) Use Stock Assets for commercial purposes within the scope of normal website operations.


4.3.3 Prohibited Uses: (a) Users shall not: (i) Redistribute or resell Stock Assets independently; (ii) Transfer Stock Asset rights to third parties; (iii) Use Stock Assets outside the Platform; (iv) Claim ownership of Stock Assets; (v) Use Stock Assets in logos or trademarks.


4.3.4 License Termination: (a) Stock Asset licenses automatically terminate upon: (i) Subscription cancellation or termination; (ii) Violation of these Terms; (iii) Expiration of the subscription term. (b) Upon license termination: (i) All rights to use Stock Assets cease immediately; (ii) Users must cease all use of Stock Assets; (iii) Any websites containing Stock Assets must be taken offline.


4.4 Intellectual Property Indemnification

4.4.1 User agrees to indemnify, defend, and hold harmless MyBuildr from any claims arising from: (a) User Content; (b) Violations of intellectual property rights; (c) Unauthorized use of content or materials.

5. DATA AND PRIVACY


5.1 Data Collection and Use

5.1.1 Information Collection: (a) MyBuildr collects and processes information in accordance with its Privacy Policy, which is incorporated by reference into these Terms; (b) User explicitly consents to the collection and processing of: (i) Registration data, including but not limited to name, email, address, and billing information; (ii) Usage data, including platform interaction and feature utilization; (iii) Analytics data, including website performance and visitor statistics; (iv) Technical data, including IP addresses, browser types, and device information.


5.1.2 Required Information: (a) Users must provide and maintain accurate, current, and complete registration information; (b) MyBuildr reserves the right to: (i) Verify the accuracy of any provided information; (ii) Suspend or terminate accounts containing inaccurate information; (iii) Request additional information as necessary for service provision.


5.1.3 Data Usage Rights: (a) MyBuildr may use collected data to: (i) Provide, maintain, and improve services; (ii) Develop new features and functionality; (iii) Generate anonymized, aggregated statistics; (iv) Comply with legal obligations.


5.2 Data Security and Storage

5.2.1 Security Measures (a) MyBuildr implements and maintains industry-standard security measures, including: (i) Encryption of data in transit and at rest; (ii) Access controls and authentication requirements; (iii) Network security monitoring; (iv) Regular security assessments. (b) While MyBuildr implements reasonable security measures, absolute security cannot be guaranteed.


5.2.2 Backup Procedures and Triggers (a) Automated system backups are created upon the following events: (i) Publishing or updating a website; (ii) Adding or removing multi-language features; (iii) Restoring from a previous backup; (iv) Deleting a site; (v) Accessing developer mode; (vi) Resetting a site; (vii) Changing a site layout. (b) Storage Limitations: (i) Maximum of fifty (50) automated backups per site; (ii) Maximum of fifty (50) manual backups per site; (iii) Daily backups of all system files and databases.


5.2.3 Data Retention (a) For Active Accounts: (i) Website backups are retained for thirty (30) days; (ii) Backups are accessible through the builder interface; (iii) Sites may be restored to any backed-up version within the retention period.

(b) For Terminated Accounts: (i) Account validation occurs within seven (7) days of inactivity; (ii) All account data is permanently deleted after the seven (7) day validation period; (iii) No data recovery options are available after deletion.


5.2.4 User Acknowledgments (a) User hereby acknowledges and agrees that: (i) User is solely responsible for maintaining their own backups of all Content; (ii) MyBuildr may delete backups older than thirty (30) days without notice; (iii) Backup restoration requests outside the retention period cannot be fulfilled; (iv) Account recovery is not possible after the seven (7) day post-termination period.


5.2.5 Limitation of Liability (a) MyBuildr shall not be liable for: (i) Data loss resulting from backup failures; (ii) Inability to restore data outside retention periods; (iii) Loss of access to data following account termination; (iv) Any damages resulting from User's failure to maintain independent backups.


5.2.6 Modifications to Backup Services (a) MyBuildr reserves the right to: (i) Modify backup frequency and retention periods; (ii) Adjust backup storage limitations; (iii) Change the backup creation triggers; (iv) Alter the backup restoration process; (b) Any such modifications will be communicated with thirty (30) days' notice.


5.3 Data Protection and Compliance

5.3.1 Regulatory Compliance: (a) MyBuildr complies with applicable data protection regulations, including: (i) General Data Protection Regulation (GDPR) for EU data subjects; (ii) California Consumer Privacy Act (CCPA) for California residents; (iii) Other applicable privacy laws and regulations.


5.3.2 Prohibited Data: (a) Users shall not upload or process through the Services: (i) Protected health information under HIPAA; (ii) Financial data subject to PCI-DSS requirements; (iii) Social security numbers or government identification numbers; (iv) Sensitive personal information as defined by applicable laws; (v) Information pertaining to minors under 16 years of age.


5.3.3 Data Processing Terms: (a) Where required by applicable law, MyBuildr offers a Data Processing Agreement ("DPA"); (b) The DPA is incorporated by reference into these Terms; (c) Users processing personal data subject to GDPR must execute the DPA prior to such processing.


5.3.4 Data Subject Rights: (a) MyBuildr will assist Users in responding to data subject requests, including: (i) Access to personal data; (ii) Correction of inaccurate data; (iii) Deletion of personal data; (iv) Data portability requests. (b) Users are responsible for: (i) Validating data subject requests; (ii) Obtaining necessary consents; (iii) Maintaining appropriate records of processing activities.


5.4 Data Breach Notification

5.4.1 In the event of a data breach, MyBuildr will: (a) Notify affected Users without undue delay; (b) Provide information about the nature and scope of the breach; (c) Take reasonable steps to mitigate any damage; (d) Cooperate with Users' reasonable investigations.


5.5 Third-Party Data Processing

5.5.1 MyBuildr may engage third-party service providers to process data, subject to: (a) Appropriate contractual safeguards; (b) Compliance with applicable data protection laws; (c) Maintenance of adequate security measures.

6. SERVICE LEVEL AGREEMENT


6.1 Support Services and Availability

6.1.1 Support Channels and Hours: (a) Email Support: (i) Available 24 hours per day, 7 days per week; (ii) Provided in English language only; (iii) Submitted through designated support channels only.


(b) Live Chat Support: (i) Available Monday through Friday, 9:00 AM to 7:00 PM Eastern Time; (ii) Excluding US and Canadian federal holidays; (iii) Subject to unexpected service interruptions or technical limitations.


6.1.2 Support Limitations: (a) MyBuildr reserves the right to: (i) Modify support hours with reasonable notice; (ii) Prioritize support requests based on severity and subscription level; (iii) Limit support for customizations or third-party integrations.


6.2 Response Time Commitments

6.2.1 Issue Classification: (a) Critical Issues: (i) Complete platform unavailability; (ii) Security-related incidents; (iii) Payment processing failures; (iv) Response target: Same business day.


(b) High Priority Issues: (i) Significant feature malfunction; (ii) Performance degradation affecting multiple users; (iii) Website availability issues; (iv) Response target: Within 24 hours.


(c) Standard Issues: (i) General inquiries; (ii) Feature requests; (iii) Non-critical bugs; (iv) Response target: Within 48 hours.


6.2.2 Response Time Measurement: (a) Response times: (i) Measured from initial ticket submission; (ii) During business hours only; (iii) Exclude weekends and holidays.


(b) Initial response may not constitute resolution.


6.2.3 Response Time Disclaimers: (a) Response times are targets only and not guarantees; (b) Actual response times may vary based on: (i) Issue complexity; (ii) System load; (iii) Factors outside MyBuildr's control.


6.3 Platform Availability

6.3.1 Uptime Commitment: (a) MyBuildr targets 99.9% platform availability ("Uptime"), measured monthly; (b) Uptime excludes: (i) Scheduled maintenance windows; (ii) Emergency maintenance; (iii) Force majeure events; (iv) Internet connectivity issues; (v) User-caused outages.


6.3.2 Maintenance Windows: (a) Scheduled Maintenance: (i) Performed during off-peak hours; (ii) Announced at least 48 hours in advance; (iii) Limited to 4 hours per month when possible.

(b) Emergency Maintenance: (i) May be performed at any time; (ii) No advance notice required; (iii) Limited to critical security or stability issues.


6.3.3 Service Credits: (a) No service credits or financial compensation will be provided for: (i) Failure to meet response time targets; (ii) Maintenance windows; (iii) Service interruptions; (iv) Failure to meet uptime targets.


6.4 Service Monitoring

6.4.1 MyBuildr will: (a) Monitor platform availability 24/7; (b) Maintain system status page; (c) Notify users of significant outages through: (i) System status page; (ii) Email notifications; (iii) In-platform alerts.


6.5 Force Majeure Events

6.5.1 Service levels do not apply during events beyond MyBuildr's reasonable control, including: (a) Natural disasters; (b) Acts of war or terrorism; (c) Internet service provider failures; (d) Government actions; (e) Denial of service attacks.


6.6 Modifications

6.6.1 MyBuildr reserves the right to: (a) Modify these service levels with 30 days notice; (b) Adjust support hours seasonally; (c) Implement emergency changes as required.


6.7 Design and Website Change Requests


6.7.1 Included Service Hours

Users subscribed to the Buildr Grow Plan receive:

  • 12 hours per year for Website Changes (valued at $50/hour)
  • 12 hours per year for Design Requests (valued at $75/hour)


6.7.2 Definition of Services

  • Website Changes: Minor adjustments to the website, including content updates, layout modifications, plugin integrations, and bug fixes.
  • Design Requests: Graphic design tasks such as social media assets, banners, email templates, and branding elements.


6.7.3 Utilization of Hours

  • Service hours are allocated on an annual basis (12-month cycle from the subscription start date).
  • Unused hours do not roll over into the next year.
  • Each request will be estimated in hours before work begins, and users must approve the estimate before execution.
  • If a request exceeds the available hours, the user must purchase additional hours at the listed rates.


6.7.4 Additional Hours and Billing
If a user exceeds their allotted hours within a subscription period, additional hours will be billed as follows:

  • Website Changes: $50/hour
  • Design Requests: $75/hour

Additional service hours are billed at the end of the monthly billing cycle or upon request completion, whichever comes first.


6.7.5 Video Requests (Not Included in Grow Plan)

  • Video requests are not included in the Buildr Grow Plan.
  • Users who require video editing, animations, or promotional video creation must purchase video service hours separately at $95/hour.
  • All video requests will be estimated before work begins, and users must approve the cost before execution.


6.7.6 Request Turnaround Times

  • Requests are completed in the order received. Estimated turnaround times are:
  • Website Changes: 3–5 business days
  • Design Requests: 5–7 business days
  • Video Requests: 7–10 business days (if purchased separately)
  • Complex requests requiring additional resources may require extended completion times, which will be communicated upon request approval.


6.7.7 Service Limitations

  • Service hours do not include major redesigns, full-scale website development, advanced animations, or full-length video production.
  • MyBuildr reserves the right to decline requests that exceed reasonable scope within the subscription tier.
  • Requests requiring third-party tools, premium plugins, or software licenses may incur additional costs.


6.7.8 Service Termination & Refunds

  • If a subscription is canceled, any unused service hours are forfeited immediately.
  • No refunds or prorated adjustments will be provided for unused service hours.

7. INTELLECTUAL PROPERTY


7.1 MyBuildr Intellectual Property

7.1.1 Ownership Rights: (a) MyBuildr and its licensors exclusively own all right, title, and interest in: (i) The Platform, including all software, technology, and tools; (ii) All modifications, improvements, and derivative works thereof; (iii) All logos, trademarks, and brand elements; (iv) All patents, copyrights, and trade secrets related thereto.


7.1.2 Prohibited Activities: (a) Users shall not, and shall not permit any third party to: (i) Reverse engineer, decompile, disassemble, or attempt to derive source code; (ii) Modify, adapt, translate, or create derivative works; (iii) Remove, alter, or obscure any proprietary notices; (iv) Access the Platform through unauthorized means; (v) Copy, reproduce, or duplicate any portion of the Platform; (vi) Attempt to circumvent any technical protection measures.


7.1.3 Limited License: (a) MyBuildr grants Users a limited, non-exclusive, non-transferable license to: (i) Access and use the Platform during the subscription term; (ii) Create and modify websites using the provided tools; (iii) Utilize the features included in User's subscription plan.


7.2 AI-Generated Content

7.2.1 License Grant: (a) MyBuildr grants Users a perpetual, non-exclusive license to: (i) Use AI-generated content created through the Platform; (ii) Modify and incorporate such content into User websites; (iii) Display and distribute such content in connection with User websites.


7.2.2 Limitations and Disclaimers: (a) Users acknowledge and agree that: (i) MyBuildr retains all rights to the underlying AI models and technology; (ii) Multiple users may receive identical or substantially similar AI-generated content; (iii) No guarantees of uniqueness or originality are provided; (iv) AI-generated content may contain errors or inaccuracies; (v) Users are responsible for reviewing and verifying AI-generated content.


7.2.3 Restrictions: (a) Users shall not: (i) Claim exclusive rights to AI-generated content; (ii) Register or attempt to register intellectual property rights in AI-generated content; (iii) Use AI-generated content to train other AI models; (iv) Resell or redistribute AI-generated content independently of User websites.


7.3 User Content

7.3.1 Ownership of User Content: (a) Users retain all ownership rights in: (i) Content uploaded to the Platform; (ii) Custom designs and layouts created by Users; (iii) User trademarks, logos, and brand elements.


7.3.2 User Representations: (a) Users represent and warrant that they: (i) Own or have obtained all necessary rights to use all User Content; (ii) Have authority to grant the licenses specified herein; (iii) Will not upload content that infringes third-party rights.


7.3.3 License to MyBuildr: (a) Users grant MyBuildr a worldwide, non-exclusive, royalty-free license to: (i) Host, store, and display User Content; (ii) Modify User Content as necessary to provide the Services; (iii) Use User Content for Platform improvement and development; (iv) Create backup copies of User Content.


7.3.4 Marketing Rights: (a) Users grant MyBuildr the right to: (i) Display User websites in MyBuildr's portfolio; (ii) Use User logos and company names in marketing materials; (iii) Create case studies featuring User websites; (b) Users may opt out of marketing uses by written notice to MyBuildr.


7.4 Intellectual Property Indemnification

7.4.1 User Indemnification: (a) Users agree to indemnify and hold MyBuildr harmless from claims arising from: (i) User Content infringement of third-party rights; (ii) Unauthorized use of intellectual property; (iii) Violations of this Section 7.


7.5 DMCA Compliance

7.5.1 MyBuildr complies with the Digital Millennium Copyright Act and will: (a) Remove infringing content upon proper notification; (b) Implement reasonable repeat infringer policies; (c) Respond to counter-notifications as required by law.

8. USER CONDUCT AND RESTRICTIONS


8.1 Prohibited Activities (a) Users shall not engage in any activity that: (i) Violates any applicable laws or regulations; (ii) Infringes upon intellectual property rights; (iii) Contains malicious code or technology; (iv) Interferes with Platform operation; (v) Harasses or threatens others.


8.2 Content Restrictions (a) Users shall not upload, create, or distribute content that: (i) Is unlawful, harmful, threatening, or discriminatory; (ii) Contains viruses or malicious code; (iii) Promotes illegal activities; (iv) Violates privacy rights; (v) Is adult-oriented or explicitly graphic; (vi) Constitutes spam or unauthorized advertising.



8.3 Technical Restrictions (a) Users shall not: (i) Attempt to gain unauthorized access; (ii) Conduct security scans or penetration tests; (iii) Exceed usage limits or quotas; (iv) Use automated scripts without permission.

9. THIRD-PARTY SERVICES


9.1 Third-Party Integration (a) The Platform may integrate with third-party services; (b) Use of third-party services is subject to their terms; (c) MyBuildr makes no warranties regarding third-party services.


9.2 Third-Party Content (a) MyBuildr is not responsible for: (i) Third-party content accuracy; (ii) Third-party service availability; (iii) Changes to third-party services; (iv) Third-party data handling practices.


9.3 API Usage (a) Use of third-party APIs is subject to: (i) API provider terms; (ii) Rate limits and quotas; (iii) Authentication requirements; (iv) Usage restrictions.

10. TERMINATION


10.1 Termination Rights (a) MyBuildr may terminate services: (i) For any violation of these Terms; (ii) For non-payment; (iii) At its discretion with 30 days notice; (iv) Immediately for egregious violations.


10.2 Effect of Termination (a) Upon termination: (i) All access rights cease immediately; (ii) Websites go offline; (iii) Data deleted per Section 5; (iv) Payment obligations remain; (v) Perpetual licenses revoked.



10.3 Post-Termination (a) Surviving provisions include: (i) Payment obligations; (ii) Confidentiality requirements; (iii) Indemnification obligations; (iv) Dispute resolution terms.

11. LIABILITY AND INDEMNIFICATION


11.1 Limitation of Liability (a) MyBuildr's liability shall not exceed: (i) Fees paid in previous 12 months; (ii) $500 USD, whichever is greater.


11.2 Exclusion of Damages (a) MyBuildr is not liable for: (i) Indirect or consequential damages; (ii) Lost profits or revenue; (iii) Data loss; (iv) Business interruption; (v) Punitive damages.



11.3 Indemnification (a) Users shall indemnify MyBuildr against: (i) Claims from User content; (ii) Violation of Terms; (iii) Unauthorized use; (iv) Legal compliance violations.

12. DISPUTE RESOLUTION


12.1 Governing Law (a) These Terms are governed by Ontario, Canada law; (b) Users consent to exclusive jurisdiction in Ontario.


12.2 Mandatory Arbitration (a) Disputes shall be resolved by: (i) Binding arbitration in Ontario; (ii) Single arbitrator; (iii) JAMS rules and procedures.



12.3 Class Action Waiver (a) Users waive rights to: (i) Class action litigation; (ii) Class-wide arbitration; (iii) Representative proceedings.

13. CHANGES TO TERMS


13.1 Modification Rights (a) MyBuildr may modify Terms: (i) With 30 days notice; (ii) By email notification; (iii) Through Platform notification.


13.2 Acceptance (a) Continued use constitutes acceptance; (b) Users may terminate if they reject changes; (c) Changes apply prospectively only.
